規范認定(ding)無效(xiao)(xiao)用(yong)地(di)批(pi)準文件。要求(qiu)各(ge)省(區(qu)、市)組織市、縣對已經(jing)合法批(pi)準的(de)用(yong)地(di)進行清查,清理無效(xiao)(xiao)用(yong)地(di)批(pi)準文件。區(qu)分(fen)是(shi)否實施(shi)征(zheng)地(di)補償(chang)安置(zhi)方(fang)案(an),分(fen)類處置(zhi),有效(xiao)(xiao)減少無效(xiao)(xiao)的(de)用(yong)地(di)批(pi)準文件。
規范認定無效(xiao)(xiao)用(yong)(yong)地批(pi)準(zhun)(zhun)(zhun)文件(jian)。要求各省(區、市(shi))組織市(shi)、縣對(dui)已經合法批(pi)準(zhun)(zhun)(zhun)的(de)用(yong)(yong)地進行(xing)清(qing)查,清(qing)理無效(xiao)(xiao)用(yong)(yong)地批(pi)準(zhun)(zhun)(zhun)文件(jian)。區分(fen)是否實施征地補償安置方案(an),分(fen)類處置,有效(xiao)(xiao)減(jian)少(shao)無效(xiao)(xiao)的(de)用(yong)(yong)地批(pi)準(zhun)(zhun)(zhun)文件(jian)。
有(you)(you)效處置(zhi)閑(xian)置(zhi)土地(di)。要求及時調查認定企業原(yuan)因(yin)造成(cheng)的閑(xian)置(zhi)土地(di),依(yi)法依(yi)規收繳土地(di)閑(xian)置(zhi)費(fei)或收回。對于(yu)因(yin)政(zheng)府及有(you)(you)關部門(men)行為(wei)及其他不可抗力造成(cheng)的閑(xian)置(zhi)工(gong)業用(yong)(yong)地(di),鼓勵通過依(yi)法轉讓、合(he)作開發等方式盤活利用(yong)(yong)。依(yi)照規劃改變用(yong)(yong)途的,報市、縣人民(min)政(zheng)府批準后,按照新用(yong)(yong)途或者(zhe)新規劃條件(jian)重新辦理相關用(yong)(yong)地(di)手續。
做好批(pi)而未供和閑置土(tu)地(di)(di)調查(cha)確認。要(yao)求(qiu)對于失效(xiao)的(de)和撤回的(de)用(yong)(yong)地(di)(di)批(pi)準(zhun)文件,由(you)地(di)(di)方(fang)逐(zhu)級匯總上報,部在相關(guan)信息系統中(zhong)予以批(pi)準(zhun);相關(guan)土(tu)地(di)(di)在年度變更(geng)調查(cha)中(zhong)按原地(di)(di)類認定,相應的(de)建(jian)設用(yong)(yong)地(di)(di)規模、耕地(di)(di)占補平衡指標、相關(guan)稅(shui)費(fei)等依然有效(xiao),由(you)市(shi)、縣人民政府具體核(he)算。地(di)(di)方(fang)各級自(zi)然資源主(zhu)管部門(men)要(yao)對閑置土(tu)地(di)(di)數據進(jin)行確認,并要(yao)求(qiu)明(ming)確處置原則、適用(yong)(yong)類型和盤活利用(yong)(yong)方(fang)式等。
加(jia)強(qiang)“增存掛鉤”機制運行(xing)的監(jian)測監(jian)管(guan)。要求地(di)(di)方各(ge)級自然資源(yuan)主管(guan)部門要加(jia)強(qiang)建設用地(di)(di)“增存掛鉤”機制運行(xing)情況的監(jian)測監(jian)管(guan)。國家土(tu)地(di)(di)督察(cha)機構要將批而未供和閑置(zhi)土(tu)地(di)(di)及(ji)處置(zhi)情況納入督察(cha)工(gong)作重點(dian)。對于工(gong)作推進不力或弄虛作假的地(di)(di)區,將依照有關規定發出督察(cha)意見,責(ze)令限期整改。
